Terri Schiavo Dead

Terri Schiavo died this morning after 14 days of court-ordered dehydration and starvation. Michael Schiavo refused to allow her parents and siblings to be at her side when she drew her last breath.

I’m disappointed. We kill thousands of children each day in this country out of convenience. It was just a matter of time, I suppose.

    This event will live on in the public consciousness for all of about 20 minutes. Shhh! CSI is on!

    I disagree (shocking). It will come up again and again during fights about the judiciary. Republicans will blame the judiciary for this — which will be risky since most Americans — well over a majority — thought that Terri had a right to refuse life-sustaining medical intervention and should have that right exercised at the discretion of her surrogate (I’m NOT saying the surrogate — ie the husband was trustworthy and got it right — i’m just reporting what i see in the polls). Anyway, this case will come up with the judiciary fight and Republicans will say, “look, the judiciary is a problem … we need judges who strictly apply the law.” Of course, the judge did strictly apply the law — he might have gotten the result wrong in light of the facts (at least in light of all the facts we know — putting aside what facts were actually put in front of him at the original trial) — but there was no judicial activism (only legislative activism, if you ask me).

    But my point is that the case will live on in the near future in the judicial fight … and, just as the Cruzan and Quindlen cases lived on for a while afterwards, this case will as well. Just a prediction.
